Terms & Conditions

Welcome to EYEMAZING EDITIONS online gallery.
These Terms and Conditions of Use apply to and govern your use of the EYEMAZING EDITIONS web site and any services that may be provided by or registered with EYEMAZING EDITIONS through the Site. By visiting our Site and using our Services, you are accepting the practices described in these Terms. If you do not agree to these Terms and the Privacy Policy, do not use the Site or request for any Services. We reserve the right to modify or amend these Terms from time to time without notice. Your continued use of our Site or Services following the posting of changes to these Terms will mean you accept those changes.

Production

Orders shall be submitted online, using the EYEMAZING EDITIONS order form.
The ordering party is obliged to provide the information requested in the order form truthfully and completely. Any damage caused by false or incomplete information shall be reimbursed by the ordering party.
The prints will be produced and executed by the EYEMAZING Artists only after placement of the order and a full payment by the ordering party.

Prints provenance

Artist (endless otherwise specified).
Each Artwork is strictly limited to the Edition number prints, handsigned and numbered by the artists.

Delivery

Should EYEMAZING EDITIONS not be able to execute an order within 8 weeks, EYEMAZING EDITIONS will promptly give notice to the customer and will refund any payments already made by that customer. EYEMAZING EDITIONS shall retain title to the delivered Artworks until full payment has been made.

Prices are exclusive VAT (for Europe), and
Exclusive customs duties and import duties, if any.

Seller's Return Policy

A Buyer may return an item purchased through EYEMAZING EDITIONS, if the item received is substantially different from it’s listing, In order to receive a refund, the Buyer must notify EYEMAZING EDITIONS of his intention to return the item as:
“not as described”,within ten (10) days of receipt.
Right of return applies only to the original purchaser, and is non-transferable.
The return of the the Artworks only acceptable in their original packaging, postage prepaid, ready for resale, undamaged and unused. The Artworks are returned at the ordering party's risk. The ordering party shall pay a reasonable compensation in case it has damaged the Artworks. In case of any loss of the Artworks prior to their return, the ordering party shall reimburse that impairment or the value of the Artworks.

Warranty and Liability

In case of damaged or incomplete deliveries, a confirmation of the deliverer must be obtained. Should the Artworks be defective upon their arrival at the ordering party despite flawless packaging, the ordering party shall promptly notify EYEMAZING EDITIONS. Defective Artworks shall be returned to EYEMAZING EDITIONS in their original packaging.

Copyright

Every displayed artist on EYEYMAZING EDITIONS online-gallery have warrant that he or she is the sole legal and Beneficial owner of the delivered artworks and that the artworks will Not contain anything unlawful and their exploitation by the online- EYEMAZING EDITIONS Gallery in accordance with this agreement will in No way infringes the intellectual property rights of any third party.
The Artworks sold by EYEMAZING EDITIONS are protected by copyright worldwide and are made available to the ordering party for its personal use and for resale only. The ordering party shall not reproduce, distribute the Artworks by third parties.
The same applies also to EYEMAZING.EDITIONS homepage and its contents.

Jurisdiction-Applicable Law

Place of performance and place of jurisdiction shall be Amsterdam. If the customer is a consumer as defined by the Dutch Consumer Protection Act, the Dutch court in the district of which the customer is resident shall have jurisdiction and shall be governed by and construed in accordance with Dutch substantive law, to the exclusion of its conflict of law rules and the UN Sales Convention.
Should any of these Terms and Conditions be or become invalid, this shall not affect the validity of the remaining terms hereof.
